Welcome to Maboko Talent. These Terms of Service (“Terms”) govern your access to and use of the Maboko Talent website, mobile applications, services, features, and related platforms (collectively, the “Platform”).

By creating an account, accessing, or using Maboko Talent, you agree to be bound by these Terms. If you do not agree with these Terms, please do not use the Platform.

1. About Maboko Talent

Maboko Talent is a community platform designed to help artists, creators, performers, innovators, professionals, and organizations connect, showcase their work, collaborate, and discover opportunities.

The Platform may allow users to:

  • Create personal or professional profiles
  • Share photos, videos, music, writing, artwork, projects, and other content
  • Connect and communicate with other users
  • Discover jobs, gigs, projects, events, and collaboration opportunities
  • Participate in communities, discussions, and virtual events
  • Promote professional services, skills, and creative work

Maboko Talent may add, modify, or discontinue features from time to time.

2. Eligibility

You must provide accurate information when creating an account.

Unless otherwise stated for a particular feature, you must be at least 18 years old to use Maboko Talent. If you are under the age of majority in your jurisdiction, you may use the Platform only with the involvement and permission of a parent or legal guardian where required by law.

Certain features or opportunities may have additional age or eligibility requirements.

3. Your Account

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs through your account.

You agree to:

  • Provide accurate and current information
  • Keep your login information secure
  • Not impersonate another person or organization
  • Not create an account using another person's identity without authorization
  • Notify Maboko Talent if you believe your account has been compromised

You are responsible for activity conducted through your account unless you can demonstrate that the activity occurred without your authorization and despite reasonable security measures.

4. User Content

You may upload, post, publish, transmit, or otherwise make available content through Maboko Talent (“User Content”).

User Content may include photographs, videos, music, artwork, writing, portfolios, comments, profiles, messages, links, and other materials.

You retain ownership of the intellectual property rights in your User Content, subject to the rights you grant to Maboko Talent under these Terms.

By submitting User Content to the Platform, you grant Maboko Talent a non-exclusive, worldwide, royalty-free, transferable and sublicensable license to host, store, reproduce, process, display, distribute, and otherwise use your User Content as reasonably necessary to operate, provide, maintain, improve, and promote the Platform.

This license does not transfer ownership of your User Content to Maboko Talent.

You represent and warrant that:

  • You own your User Content or have the necessary rights and permissions to submit it.
  • Your User Content does not unlawfully infringe another person's intellectual property, privacy, publicity, or other rights.
  • You have obtained any necessary permissions from people appearing in your content.
  • Your User Content complies with these Terms and applicable laws.

You should not upload content that you do not have permission to use.

5. Public Content

Some information and User Content may be visible to other users or the public depending on your account settings and the features you use.

You should carefully consider what information you publish.

Maboko Talent cannot guarantee that content shared publicly will remain private, even if you later delete it. Other users may have viewed, copied, downloaded, or shared content before it was removed.

6. Acceptable Use

You agree to use Maboko Talent responsibly and lawfully.

You must not use the Platform to:

  • Violate any applicable law or regulation
  • Harass, threaten, stalk, intimidate, or abuse another person
  • Engage in discrimination or hateful conduct
  • Impersonate another person or organization
  • Create fraudulent profiles or opportunities
  • Scam, defraud, or deceive users
  • Publish malicious software, viruses, or harmful code
  • Attempt to gain unauthorized access to accounts or systems
  • Scrape, harvest, or collect user information without authorization
  • Send spam or unauthorized commercial communications
  • Manipulate engagement, rankings, or platform features
  • Infringe copyrights, trademarks, or other intellectual property rights
  • Publish content that is sexually exploitative or involves the sexual exploitation of minors
  • Facilitate illegal activities
  • Use the Platform to distribute content that violates another person's privacy or legal rights
  • Interfere with the operation or security of Maboko Talent

Maboko Talent may remove content or restrict accounts that violate these Terms.

7. Jobs, Gigs, and Opportunities

Maboko Talent may provide listings or connections involving jobs, gigs, freelance projects, collaborations, auditions, partnerships, or other opportunities.

Maboko Talent is not the employer, agent, talent manager, or representative of users or organizations unless expressly stated otherwise.

We do not guarantee:

  • The accuracy of an opportunity listing
  • That an opportunity is legitimate
  • That a user or organization is qualified
  • That a user will receive work, payment, employment, or a contract
  • The quality, safety, legality, or outcome of any transaction or relationship

Users are responsible for conducting their own due diligence before accepting an opportunity or entering into an agreement.

Never send money, sensitive personal information, passwords, financial credentials, or identity documents to another user unless you have independently verified the recipient and have a legitimate reason to do so.

8. User Interactions

Maboko Talent provides tools that allow users to communicate and interact.

You are solely responsible for your interactions with other users.

Maboko Talent does not guarantee the identity, background, qualifications, intentions, or behavior of any user.

Use appropriate caution when meeting someone you first encountered online, entering into business arrangements, or sharing personal information.

9. Intellectual Property

The Maboko Talent name, logo, branding, software, interface, design, graphics, text, features, and other materials provided by Maboko Talent are owned by or licensed to Maboko Talent and may be protected by intellectual property laws.

Except as expressly permitted by these Terms, you may not copy, modify, reproduce, distribute, sell, license, reverse engineer, or create derivative works from Maboko Talent's proprietary materials.

Nothing in these Terms grants you ownership of Maboko Talent's intellectual property.

10. Copyright Complaints

If you believe content on Maboko Talent infringes your copyright, you may contact Maboko Talent with information sufficient to identify:

  • The copyrighted work you believe has been infringed
  • The allegedly infringing content
  • Your contact information
  • A statement that you have a good-faith belief that the use is unauthorized
  • A statement confirming that the information you provide is accurate

Maboko Talent may remove or restrict allegedly infringing content and may take action against repeat infringers where appropriate.

11. Privacy

Your use of Maboko Talent is also subject to our Privacy Policy, which explains how we collect, use, disclose, and protect personal information.

You should review the Privacy Policy before using the Platform.

12. Third-Party Services and Links

Maboko Talent may contain links to or integrations with third-party websites, applications, services, payment providers, or other resources.

Third-party services are governed by their own terms and policies. Maboko Talent is not responsible for the availability, accuracy, security, or practices of third-party services.

13. Payments and Paid Services

Certain Maboko Talent features may be offered for a fee.

Where applicable, pricing, billing terms, renewal terms, taxes, cancellation rules, and refund policies will be disclosed before you purchase a paid service.

You authorize Maboko Talent or its payment provider to charge the applicable payment method for authorized purchases.

Unless otherwise required by applicable law or expressly stated by Maboko Talent, payments may be non-refundable.

14. Platform Availability

We strive to keep Maboko Talent available and reliable, but we do not guarantee uninterrupted or error-free operation.

The Platform may occasionally be unavailable because of maintenance, updates, technical problems, security incidents, network failures, or circumstances beyond our reasonable control.

We may modify, suspend, or discontinue all or part of the Platform at any time.

15. Account Suspension and Termination

You may stop using Maboko Talent at any time and may request deletion of your account subject to applicable policies and legal requirements.

Maboko Talent may suspend, restrict, or terminate your account if:

  • You violate these Terms
  • You engage in fraudulent or abusive activity
  • Your activity creates a security or legal risk
  • Your account is used to harm other users
  • We are required to do so by law
  • We discontinue the Platform or a particular service

Where appropriate, we may provide notice and an opportunity to resolve the issue before taking action.

Sections that by their nature should survive termination will continue to apply after your account is terminated.

16. Disclaimers

To the maximum extent permitted by applicable law, Maboko Talent is provided on an “as is” and “as available” basis.

Maboko Talent does not guarantee that:

  • The Platform will always be available
  • Content will always be accurate or reliable
  • Opportunities will be legitimate or suitable
  • Users will behave appropriately
  • The Platform will meet every user's expectations
  • Content will never be lost, altered, or damaged
  • The Platform will be completely free from security vulnerabilities

You use the Platform at your own risk.

Nothing in these Terms excludes or limits rights or protections that cannot legally be excluded or limited under applicable law.

17. Limitation of Liability

To the maximum extent permitted by applicable law, Maboko Talent and its owners, employees, contractors, affiliates, partners, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from or related to your use of the Platform.

This includes, where legally permitted, losses relating to:

  • User interactions
  • Employment or business opportunities
  • Lost profits or revenue
  • Lost data
  • Unauthorized access
  • User Content
  • Third-party services
  • Transactions between users

Nothing in these Terms limits liability that cannot legally be limited under applicable law.

18. Indemnification

To the maximum extent permitted by applicable law, you agree to defend, indemnify, and hold harmless Maboko Talent and its owners, employees, contractors, affiliates, and service providers from claims, damages, liabilities, losses, costs, and expenses arising from:

  • Your use of the Platform
  • Your User Content
  • Your violation of these Terms
  • Your violation of another person's rights
  • Your violation of applicable laws
  • Your interactions or transactions with other users

19. Changes to These Terms

We may update these Terms from time to time.

When we make material changes, we may provide notice through the Platform, by email, or by another reasonable method.

Your continued use of Maboko Talent after updated Terms become effective means you accept the revised Terms.

20. Governing Law

These Terms will be governed by the laws applicable in the jurisdiction specified by Maboko Talent, without regard to conflict-of-law principles, except where applicable law requires otherwise.

Any dispute will be handled in the courts or dispute-resolution forum having appropriate jurisdiction, subject to any mandatory consumer protection or other applicable legal rights.

Before publishing this section, Maboko Talent should insert its actual governing jurisdiction and venue.

21. General Terms

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in effect.

Our failure to enforce a provision does not constitute a waiver of our right to enforce it later.

These Terms, together with any policies expressly incorporated into them, constitute the agreement between you and Maboko Talent regarding your use of the Platform.

You may not assign your rights or obligations under these Terms without our prior written consent, except where permitted by law.
